Not knowing the circumstances of your son's dismissal, I can't comment on that. But Indiana is an "at-will" state. An employer can fire someone for any reason or no reason. As a thirteen year employee, your son was probably much more expensive than a new-hire would have been, so that's one "no reason" to look at. However, the employer can't prevent the dismissed employee from getting COBRA, unless the employee was fired for gross misconduct. Since your son's employee didn't protest his unemployment, they should not have been able to mess with his COBRA benefits.

As for your son being initially denied unemployment benefits, if he told the Work-One office he was fired, an automatic denial would have been issued. Just as an automatic granting of benefits would have been issued if he said he was laid off. The employer would have received a questionnaire on the circumstances of the firing. If they didn't return it, or could not demonstrate willful misconduct on the part of your son, he would then receive the benefits.

I'm not saying Lowe's did the right thing. But it is just as possible the unemployment office was the party that delayed your son's benefits. And I don't understand how his COBRA rights could have been affected by either entity.

  It always seem to be something, lost papers, the wrong turned in.  He was out of work for over a month without receiving any money and insurance.  I know I was making his house and car payment a buying food.  We think there was some things that helped in his firing. 

  1. He had to file bankruptcy because of his wife illness and medical cost.  I imagine that the insurance company was glad to see him go.

   2.  He was the top paid hourly employee in the store.  He was a Mill Work Specialist, custom doors and windows.  Highest hourly paid (he had been with Lowes in Anderson) the longest) and with his commissions in the custom door and windows.   He was #1.

   He had contractors who would business only with him on doors and windows.  He had two contractors call him the next day after he was fired to say they were sad to seem him go.  I talk to the store manager who fought to save his job and now has been moved some were.  Said that he couldn't comment on the firing because he could lose his job.  Said, he will be truly missed.

  He had been manager for the Mill Work department for 10 years, when a new store manager came in and gave he the whole lumber department on top of the mill work, increasing his work 3 times, and with no pay raise.  Also with out any help to learn how to run it.  This asshole would chew him out in front of the staff in meetings.  He ask to go back to hourly.  Guess what, the first month he was back me made more money without any responsibility and less hours.

  But you know the bastards did him a favor.  He was unemployed for 4 months.  Seems that there is not to much demand for Mill Work Specialist.  He now works as a  maintainace man at one of the largest hotels in Indiana.  He had to take a $2 cut in pay and loss all of his commissions.

  He told me the day, it's like heaven to get out of that pressure cooker of Lowes,  where you never see any old, long time workers.  Hell, they even have the cook feed  him at lunch and twice on Sunday when he works a 12 hour shift.  Plus he has all of the insurance he had at Lowes even better.

  You ought to Goggle in "People who hate Lowes"  I use to love to shop at Lowes, spent thousand of dollars with them remodeling my 130 year old house.  But, I never knew how they treated their employees.  Their are on par with Walmart that has a turn over rate of over 52% each year.  Companies that treat their employee right, the people don't quit.  That's why I don't shop Walmart and Lowes.

  One more thing Lolly, his firing created such a mistrust and bad feeling among the hourly workers, that Lowes World Headquarters came in and change all of the upper management.  And had meeting to tell the employees that Lowes could be trusted and everthing would get back to order.

   It didn't change a thing, they still don't trust headquarters.  One man who had be with Lowes in Anderson for awhile said.  If they can fire Rob for what they say he did, my job is hanging by a thread.

  Robert Niblock Lowes CEO age 47, was a bean counter for a big bank of wall street 10  years ago.  The past CEO hire him to do taxes for Lowes.  He must have done a good job, because he was made CEO 5 years ago.  In the year of 2008 Lowes lost 21% because of the housing bubble.  Old Robert got a 13% raise.  Raising his wage to $54.5 million a year.  He sure knows how to count bean,s especially for him self.  You ought to see his house, it's big enough to be a college.  Glen Beck should feel humble when he look at Old Bob's house.

Some jobs are like being in hell. I don't work in hell now, but I did once. The day I sat in the parking lot weeping because I had to go in there to work, I realized I had to get out. So I did. I took a pay cut, but I managed to claw my way back. Since then I have jumped twice more, but because I got a better offer, not because I had to get out or go crazy.

One of the saddest things about the present shitty job market, is that people really are held hostage to jobs they hate. I'm glad your son landed on his feet.

My personal code says I can't bad-mouth a company while I'm taking their money, but once I'm gone, so is all obligation to be civil. I love my present job, but the company who's parking lot I cried in still cringes when my name is mentioned. I left scars. You and your boy should get a certain satisfaction knowing you steer customers away from Lowe's every day. Keep it up.

  LollY, Lolly, got one more story.  Remember the 18 year old was ask by the store manager it she wanted to do a threesome.

  My daughter in law was working there and a lady gave her two $50 bills to buy some things.  Well  one of the $50's came up missing and the manager blamed my daughter.  Well, when the work schedule came out her name was not on it and the manager went of vacation.  In my daughter's mind, meant she was fired.  She talked to me about it and I said, stand up and do something about it, she wants you to go away.  Ann had talked to one of her friend and said have you looked under the cash drawer.  The manager wouldn't take the drawer out.

  Two week later Ann filed a complaint with Big Lots HR office.   The next day the district manager called her to the store and Ann told him the story.  He went over to the cash register took out the drawer and there was the $50 and a $10 bills under the drawer.   She also told hij the she hadn't got her last pay check or payed for her week in Ohio setting up a new store.

  Yesterday she heard from Big Lots that she had her job back and she would receive all of her money and the money for her time off of the unjust firing of her.  There are some good Humans in the Human Resource departments.

  How does Whirlpool reward the American government and it workers and people of the U.S.A..  Their are moving their plant to Mexico.

Hum, lets see now.  If there was one so called racist in the tea party and that makes the whole tea party racist then shouldn't it follow that since Obama went to an openly racist church for all those years that he is a racist?  I mean lets be fair now. Come to think of it Byrd was in the KKK so he must have still been a racist and only said he changed for political gain because a person can't really have a change of heart on those matters now can they?
