This is a newer law, so it will take time, for people to get used to it.

Yes but you shouldn't have to be the ones enforcing it.  If the state wanted the law so badly then they need to hire the smoking police and leave you to fight with people about hot wings!
He he, I don't work in the drive thru, but my coworkers do, and I'm sure it's gonna get ugly.  :spooked: It just rolls off of us fast food workers though, we're treated sooo bad most of the time, we're immune to it. Most of the time when a customer says, or does something mean, we all stand in the back, and mock and make fun of them . We get a lot of laughs at the customers expense, they just don't know it.  :icon_twisted: And we ALWAYS  remember the ones that are assholes too.

Sorry, but I don't think it's a stupid law at all. Why should your health be jeopardized w/secondhand smoke? I'm sure KFC isn't going to pay workman's comp if you come down w/lung cancer (or other cancer). I like the rule about being a certain distance from a building too. I hate walking out the door and right into a cloud of smoke. If someone is standing near the building smoking, I can avoid him/her and I don't mind that - so I'm not talking about taking away smoker's rights at all, but I can't really avoid them if I have to go through the door.

California has a new law (at least I think it's the entire state) which outlaws smoking in a car w/a child. I LOVE IT! I don't smoke, but I don't want my kids traveling in a car where they're trapped in w/the smoke if they happen to be with someone who smokes.

But you're missing the point here PIYA.  In your car at a drive-thru window isn't in anyones face with it especially if you have it in the ash tray.

Spoken like a smoker. So the smoke doesn't curl up from the ashtray into the car and out the window? How many people drive SUV's today? SUV/Truck windows are even w/the drive thru. So, they make a law that only people who drive SUV's aren't allowed to smoke at the window? Don't think so.

You aren't at a drive up window that long for one thing and if the other window isn't open the smoke stays in the car.  Now if you take a drag of it and blow it out the window into the cashiers face thats not only rude but a different story.  It still shouldn't be up to a cashier to tell someone they can't smoke in their own car nor is it the business of the city or anyone else to sue the restaurant if they don't.

I don't want ANY secondhand smoke in my face. I have a right to breath clean air. It's my opinion that many smokers don't really intend to infringe on others, but I also don't believe that all smokers are aware of where their smoke goes or who it effects. If your window is open to the drive through and your car contains smoke, some of it is going to go in the window. It doesn't take long for the cashier to be exposed to it.

That happens also and the only way to stop those that do is to stop everyone. They can't make a law for only the rude people. Just like they can't make a law just for the people who have windows that meet evenly with the window. It has to be all motorists. For some, it may be ridiculous...for example a person in a Miata. However, there's no way around that ... that I see.

This I agree with. Unfortunately, many of the laws everywhere are difficult to enforce. I think this would be one of them. Unless, the public knows the cashier have the power to report them. Whether they do or not should be up to the individual.

I think I'd be more worried about the effects of the car exhaust than cigarette smoke.

That is a concern overall...global warming and all that...but unless the tail pipe is somehow shoved through the window, the cigarette smoke is closer and aimed directly from window to window. Multiply one car w/cigarette smoke blowing into the cashier's work area, by the number of possible cars and smokers that go through a drive through. He/She isn't exposed occasionally, he/she is exposed continuously.

Hopefully, there are measures coming down the pike to deal w/the pesky car exhaust problem too.

QuotePassive Smoking is Dangerous
Secondhand smoke is a toxic cocktail consisting of poisons and carcinogens. There are over 4000 chemical compounds in secondhand smoke; 200 of which are known to be poisonous, and upwards of 60 have been identified as carcinogens.

When a cigarette is smoked, about half of the smoke is inhaled / exhaled (mainstream smoke) by the smoker and the other half floats around in the air (sidestream smoke).

Environmental tobacco smoke (ETS) plays a part in more health problems than you might realize. The following facts point out why it is so important to have smoking bans in place. No one should be forced to breathe in air tainted with cigarette smoke.

There are a lot of links here re: secondhand spoke - be aware of who it effects.

The whole point is when is it all going to stop.  They are already trying to control what we eat too as well as how we feed our kids and this is getting to the point of ridiculous.  I'm highly allergic to perfume and there are others who could end up in the hospital from getting too close to someone with it on.  Are they going to tell people they can't wear perfume outside their own houses or in cars with kids in them next?  And, yes, it is a health hazard.  Have you ever talked to someone with asthma?

PIYA I understand your point, but I'm trying to think about how many times I was in a fast food restaurant and thought "OMG can you smell that smoke coming from the drive thru?"  I'm hard pressed to find that memory.  But then again, my brain is fried!

Peanut butter has been outlawed or restricted in a lot of elementary schools because of allergies.  Who knew that some were so bad that the smell of it was enough for a reaction.

Ya know, I bet if I hung my ass out a drive up window and farted in the general direction of a smoker in a car, they would raise holy hell with me.

Second had smoke travels far and effects many.  I hate to get stuck behind a smoker in a drive up in my car or truck, because the smoke gets sucked into MY vehicle if the wind is wrong.  I have the same problem at stop lights too.  I'd rather be behind a cattle truck.
