Bisard Back At It. . .

Officer David Bisard will go back to court Wednesday for his most recent arrest for suspected DUI. In the meantime he remains in jail on a $25,000 bond, despite prosecutor's requests that he not be released.

The Marion County Prosecutor's office confirmed Sunday morning that they will file a motion to revoke Bisard's bond in the pending case against him.

The Indianapolis Fraternal Order of Police say they could potentially change their contribution to his legal defense. There is a business meeting scheduled for Thursday where the topic could be brought up for discussion.

The speed limit sign cannot be seen, and the guard rail that is designed to protect cars from going down into a ravine has been tested. Allegedly the driver that did the damage is suspended Metro Police Officer David Bisard.

The police report states that when "Officer Rhoton asked Bisard how many alcoholic beverages he had consumed and Bisard stated, 'I'm not really sure, I've been drinking since noon and I'm not gonna say I've had two like everyone else does.'"

Bisard is said to have been going east in his pickup truck on Indian Lake Boulevard, when he crossed over the narrow street, ramming his vehicle into the sign and guard rail. A neighbor heard the crash and called police. Bisard was found with glassy eyes and was unsteady, the police report stated.

Bisard stated to Officer Rhoton, "I know you know who I am. I messed up today. If you guys can cut me a break I promise I will never drink again."

The police report states Bisard continued to plea with the officer to let him go, stating that if he goes to jail his life will be over.

The Lawrence officer had reason to believe the embattled Metro Officer had been drinking. A source close to the investigation tells Eyewitness News that David Bisard failed a field sobriety test.  Bisard is reported to have had a blood alcohol content of .17 - more than twice the legal limit to drive in Indiana.

No sooner was the crash scene cleared up when investigators from Indianapolis Metro police were there asking questions.

Questions that may not be answered anytime soon.  No one associated with the case is talking.  Lawrence Police have handed the case to the Marion County Prosecutors office.  And Indianapolis Metro Police say it they have nothing to do with case.

Lawrence police took Bisard to Wishard Hospital for another blood test, and then handed him over to the Marion County Sheriff's department at the Adult Processing center where he will allegedly have to sober up before going in front of a magistrate.

The Marion County Prosecutors office has confirmed they have asked that Bisard not be released on bail and will ask that his current bond be revoked in a hearing Monday morning.

Maybe he doesn't have a valid license. I don't know the criteria for taking a license away from someone, but you might be surprised at how many people who come into the er from a car who were driving without a valid license.

I would think that when your operation of a motor vehicle involves imposing death and serious injury upon 3 human beings, and impairment, you lose your license!

His BAC was twice the legal limit in the current instance. He is charged with reckless homicide in the first incident and legal rulings have admitted the BAC in the first incident as well. He knew beyond a doubt that taking the risk of driving a motor vehicle after drinking would jeopardize his freedom as well as the verdict in the first case.

He knew a second incident would likely ruin any chance he had of clearing himself of the first charges.

He is a killer drunk that still had a valid drivers license and I have to ask why?

Any one of us would have had our license suspended /  revoked after the first incident, and would have been sitting in the sin bin; why wasn't he?  :mad: :mad: :mad: :mad:

  What got me was when the killer drunk was arrested he ask the cop for, "cut me a break, I'll never take another drink."  What kind of break did the bastard give the motorcyclist he killed.   :rant:

And because of the whole controversy surrounding the first incident, and the supposed failure to follow protocol surrounding the collection of his blood for BAC testing, the judge let him keep his drivers license! Do you think they'd do that for any one of us? He'll no.

This is twice now he has been caught driving at 2 or more times the limit on BAC. He should be incarcerated until his trial date.

I guess we should revisit the initial incident for the newcomers.

Bisard is a suspended Indianapolis police officer (K9) who in August of 2010 responded of his own accord, despite being called off by dispatch, to a warrant service call. He was on duty at the time and responded with speed and recklessly to the call, hitting a group of motorcyclists that were stopped at an intersection.

A blood draw done on him some hours after the incident found he was at least 2 times over the legal limit for BAC. He killed one of the motorcyclists and critically injured two more of them.

The officers on scene said they had no indication He was intoxicated. Including leadership . His mandatory blood draw was performed at a clinic as opposed to. Being drawn by a certified technician at a hospital as required by law.

The ensuing FUBAR has resulted in his suspension, years of legal wrangling, and is now scheduled for trial outside of the county in which he committed his murderous act in the coming weeks. He has been free to live his life for two + years and has now been arrested for wrecking his father in laws truck over the weekend and being found to be intoxicated at 2+ times the legal limit, and with a bottle of vodka in the truck.

It appears he got out on 25k bond this afternoon, but his license is suspended.

The Marion county prosecutor is going to file with the Allen county judge hearing the first case to have his bond revoked and Bisard incarcerated until his October Trial date on the first case.

One think I know about this guy is, according a co-worker whose friend is an INDY Cop, said that NOBODY on the force liked this guy...he had an attitude of arrogance.....but, that is how rumors get started, huh?
