I finally came up with forty after coming up with 36 .... finally figured out where I was missing four....I can't imagine anymore than that being possible.

I don't understand that either and it has me puzzled also because I know there are two somewhere tied to the two I'm missing.  Either that or I counted two of the 4 missing twice. Gonna do it again.

Agreed, unless you cannot count the squares intersected by the two squares containing the smallest squares as squares.  I saw an IQ test with a trick question like that once.
