I beg to differ on the laws in Indiana not working.  Where my daughter was working a few years ago some people who were fired for a valid reason went to a lawyer who filed suit in their behalf and the company proved why they were fired and still had to pay back pay and take them back.  Of course they got fired again because they still didn't show up, showed up late, and didn't do their job but the law does work.  The company closed its doors about 3yrs ago.  Oh and Troll, it was a non union place and they were paid very well and had excellent benefits.

  Most places that pay high wages and have good working conditions want good workers and want to keep an union out.  You can count on that.  I sure would like to read the court case on that little deal your daughter and her friends pulled.  Since they didn't go back more of less proves they weren't worth a damn as workers to start off with.

You can beg all you want, but the reality is the average worker who gets fired in this state cannot afford an attorney and the corporate world damned well knows it. Trying to enforce labor laws in this state is akin to pulling your own teeth with a set of pliers, and in the lions share of cases the fired employee cannot even collect unemployment until they appeal, and then have to wait 90 days or more for a hearing to which the employer more often than not doesn't show up. . . Then, and only then, will they be able to collect unemployment.

And with Indiana's "at will" status, trying to demonstrate that you were fired without just cause is akin to awaiting the second coming of the Christ. In this state they don't have to have a reason. They do whatever they want, when they want, and if you cannot afford an attorney you are SOL. Period.

If you work for minimum wages you are toast no matter how you look at it.

Before I was moved to Indiana I hated unions and held opinions close to those expressed by Nighthawk surrounding them. Indiana changed my mind and in a real hurry. I have seen first hand how the "at will" status stacks the deck against any worker who is not under the mantle of a union collective bargaining agreement. (And I work for the other side). I have seen the approach this status enables employers to assume, and they do so with gusto whenever they decide and to whomever they decide to.

That status enables corporate Amerika to downsize by eliminating individuals who have toiled their entire lives for a chosen company, and cast them out as if they were a steaming pile of dog excrement.  And it doesn't matter if they are esteemed and respected professionals within their industry either. If you've been there 10-20 years, never missed a day, and your work is the best in the field, they'll cut you quicker than you can blink, and don't have to give a reason. I've seen it done over and over and over again in this state. And when the big dog barks you jump or risk being bitten yourself.

And the next day they'll have some wet behind the ears college graduate in your place for 1/4 the salary too. And the only thing you can do is be pissed off about it in this state. Anyone who doesn't believe that and lives in this state is either a business owner, or the next victim waiting to happen.

The at will status of this state nurtures the union environment simply because the corporations doing business within it abuse the hell out of anyone not covered by a collective bargaining agreement. Any company not covered by such will simply produce a dog and pony show by syaing they have a progressive line of discipline program, and performance improvement plans, all of which is nothing more than a paper tiger. They rarely if ever use it, and when they do it is typically rift with manufactured "evidence" and exaggerated "facts" that are no more than lies spun to represent the truth they want it to.

And on top of this the state labor board is a joke, because the first thing they'll ask you for is proof you were unjustly terminated, and with at will status that allows termination for no reason and allows corporations to terminate without providing a reason, that is impossible to do. Unless you fall into a "protected class" surrounding race, gender, sexual orientation, or physical handicap, you are SOL. I'd say age, but proving age discrimination is just as impossible.

I dare say that in the case you quoted the attorney made out like a bandit, because s.he either got paid up front, or took all of any award the plaintiffs were provided with as remedy.

Corporate Amerika has become lazy in states that carry at will status. They realize that they don't have to go through the progressive line of discipline, they don't have to enforce performance improvement plans in order to build a case strong enough to justify termination. So they don't. And because of the laziness this nurtures, management on the front lines of labor do nothing to correct bad behavior or performance until it becomes so habitual that it negatively reflects upon them. Then they make a half hearted attempt to rehabilitate what they allowed to become a hard case, and upper management decides to just cut them loose because it is going to require "too much effort" to implement a policy to correct a behavior and administer it fairly and consistently, and its the quicker fix to just fire them because it requires substantially less effort and paperwork.

Believe it or not I do agree with most of what you say about the "at will" status of Indiana. But, most, if not all of the professionals that you speak of would be salaried and never be a member of the union anyway. As I stated before, the only ones the unions protect are the dregs. The ones who are a drain on the company and the honest workers there These are also the ones keeping a good worker unemployed and preventing the company from being able to hire good workers to keep themselves afloat.

Like "Me" I have seen the laws here work and people successfully sue companies for wrongful termination.

And one more thing. America is spelled with a "C" not a "K". You are a citizen of the United States and as such should show more respect for your, and my, country by spelling the name of it correctly.

  If you don't have a contract with a company or they fire you for something you didn't do and you can prove it your ass is grass.  Because if you get your job back the relationship with the business is so poisoned so bad your job will still disappear.

  I know one woman was fired for stealing a $100 bill, come to find out the manager had set her up by slipping the bill under the cash drawer.  The Dollar Store company investigated and found the $100 bill and the manager was fired.  The manager forgot about the over head camera.  The woman got her job back and got a raise.  The Dollar Store is a good employer.

  Over the years I have found most anti-union people don't know what their talking about, got most of their information from scabs or from pro corporations news sources like for one, Fox News, The Republican Party and Anti-union websites.  They have never belonged to a good union and never read a good book on the good things unions have done for the America worker and the American middle class.  :salute:  Unions :no1: :4th2:  and every other day in America.  :biggrin:

I meant it EXACTLY as Troll interpreted it; something you obviously fail to see or do not want to. That's okay, you have that right as well.

When it comes to the corporate world in this country, more specifically this state, it is indeed akin to the Iron Fist of Communism from my perspective. So "Америка" it is.  :yes:
